The Blackbirds Infotech Srl guarantees the protection and the necessary confidentiality of personal data as presented in the following statement .

 In this disclosure, in line with what has been described in EU Regulation 679/201 6, as also applied in Italy as a result of the legislative decree n.101 of 10.08.2018 (hereinafter the Decree ") , the types of personal data in our protection are described and the purposes for which these are collected, stored, processed and communicated to third parties . According to Decree No. 2 - sexies Comma 2, the Blackbirds Infotech Srl undertakes to prepare the following information in a clear and simple, concise and comprehensive manner, easily accessible and understandable.

Any report of non-compliance with existing legislation or improvement, the interested party may send email to supporto@blackbirds.com, specific assistance ticket will be opened and assigned to a consultant in 2 hours from the notification of the request for change. The response times will be so short for us because the PROTECTION OF HIS PERSONAL DATA PRESENT IN OUR COMPANY IS FOR US AN ORGANIZATIONAL PRIORITY.

The personal data of customers and suppliers are those indicated in the contract, in its role or in other documents with Blackbirds Infotech Srl, and can be integrated with those relating to relationship events.

In no case does the company resell your personal data to third parties, nor use them for undeclared purposes and in the event they are communicated to third party companies ( Data processing managers ), these companies and professionals are necessarily compliant with the GDPR Regulation and the contracts which regulate the common activities , signed with the Blackbirds Infotech Srl, provide for compliance with personal data protection obligations.

Collected data , Consent and Purpose

 Personal data such as (by way of example) name, physical address, province or municipality of residence, telephone, email address (es), etc.

  Data voluntarily provided by the interested party Within the Web Site www.blackbirds.com it is possible to fill in forms , through which contact, assistance or download of informative material (brochure, factsheet) is required.

The Blackbirds Infotech Srl is aware of and implements data processing processes , through the use of telephone calls and paper mail for the purposes of sending advertising material or direct sales or for carrying out market research or commercial communication, only with respect to of those who have not exercised the right of opposition , by registering the numbering of which is holder and other personal data in a public register of oppositions. (Art 130 Paragraph 3 ).

In case in which the Blackbirds Infotech Srl uses, for the purpose of direct sales of its products or services, the e-mail coordinates provided by the interested party in the context of the sale of a product or service, makes use of the information contained in Art. 130 Paragraph 3-bis of the Decree, or may not require the consent of the interested party, provided that they are services similar to those of the object of sale and always if the interested party, adequately informed, does not refuse such use, initially or in occasion of subsequent communications.

The interested party, at the time of collection and at the time of sending any communication made for the purposes for which he is informed of the possibility of opposing the processing at any time, easily and free of charge. Also the Blackbirds Infotech Srl guarantees the presentation of the identification of the line of calls and to provide the user with suitable information, in particular on the possibility and the modalities of registration in the register to oppose future contacts.

As reported in Decree No. 2-septies Section 5, the Blackbirds Infotech Srl will adopt adequate guarantee measures for personal data, including security measures, including encryption techniques, minimization measures, access management and strong password policies for corporate information system users, presence of firewalls and antivirus systems updated every hour, operating systems that are always up-to-date as well as any other measures to guarantee the rights of the Interested Parties. In any case and as required by Regulation (EU) 2016/679 , in the event of a data breach the Blackbirds Infotech Srl will communicate, within 72 hours of the incident, the event to the Italian uthority and to the interested party accompanying the information of all the measures put in place to reduce the risk of damage for those interested in the Data Breach .

Blackbirds Infotech Srl will respond for the damage caused by the processing if it has not correctly fulfilled the obligations set forth in the GDPR, even by the third party companies responsible for the treatment, or if it has acted in a different way or against the legitimate instructions of the data controller .

 The company does not require the interested party to provide so-called "sensitive" data, that is, according to the provisions of GDPR art. 9, personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as genetic data, biometric data intended to uniquely identify an individual, health data or to the sexual life or sexual orientation of the person.

As stated in Article 9 Section 1.c) of Legislative Decree No. 101 of 10/08/2018 in the cases of receipt of curricula spontaneously transmitted by the Interested parties for the purpose of establishing a working relationship, the consent regarding the personal data in the curricula is not due.

As part of the domestic work relationship of teleworking and agile work, the employer, as reported in the notes to Article 9 of Legislative Decree 101 of 10/08/2018,  Blackbirds Infotech Srl will guarantee to the worker the respect of his personality and his moral freedom. The domestic worker will be required to maintain the necessary privacy for everything related to family life.

 

Transfer of personal data

Personal  data will not be transferred to non-European countries that do not respect the protection of personal data and have no specific agreements with the European Community in this regard .

 

Data retention

The data will be processed in full compliance with the principles of confidentiality, correctness, necessity, relevance, lawfulness and transparency imposed by the Regulation for the time necessary to achieve the purposes for which the data were collected and, in any case, not more than 5 years from their collection for the purposes of the Service or, in the case of purchase of Services / Products, for the time necessary for the execution of the contractual conditions.

 

User rights

 The right to obtain confirmation of the existence or not of personal data concerning you, even if not yet recorded, and their communication is in intelligible form.

Right to obtain information:

I) Of the origin of personal data;

II) Of the purposes and methods of processing;

III) Of the logic applied in the case of processing carried out with the aid of electronic instruments;

IV) The identity of the owner and manager;

V) Of the subjects or categories of subjects to whom the personal data can be communicated or who can learn about them as managers or agents.
